Is “Ecosem Grup” S.R.L. bankrupt or in liquidation?
No. “Ecosem Grup” S.R.L. is in insolvency proceedings with restructuring, not liquidation. The Restructuring Plan was accepted by the creditors’ meeting on 06.06.2018, confirmed by the judgment of the Chisinau Court (Centru seat) of 02.07.2018, and became irrevocable through the decision of the Chisinau Court of Appeal of 09.10.2018. The company continues to operate under the supervision of the insolvency administrator and the court.
Who currently manages the company?
The insolvency administrator is Vladimir Balan, an authorized administrator appointed by the ruling of the Chisinau Court of Appeal No. 2i-570/17 of 20.11.2017 and confirmed by the judgment of the Chisinau Court (Centru seat) of 02.07.2018. The company’s economic processes are managed by administrator Minodora Rucan. Both act under judicial supervision, pursuant to Insolvency Law No. 149/2012 and Law No. 161/2014 on authorized administrators.
What happens to the proceeds from the sale of assets?
Under the Plan confirmed by the insolvency court, the company’s assets are realized under the supervision of the administrator and the court solely in order to satisfy the creditors’ claims. The administrator does not dispose of these sums freely: their destination is set by the court-confirmed Plan and verified by the court.
Are the proceedings contested or still pending?
The judgment of the Chisinau Court (Centru seat) of 02.07.2018, which confirmed the Restructuring Plan and the insolvency administrator, was upheld by the decision of the Chisinau Court of Appeal of 09.10.2018 and thereby became irrevocable. The legal basis of the restructuring is therefore no longer subject to ordinary appeal.
Who is entitled to use the name and trademark “ECOSEM”?
The trademark “ECOSEM” is registered and protected under AGEPI certificate No. 42274. Use of the mark by third parties without the owner’s consent — including in headlines, advertising materials or domain names — falls under Law No. 38/2008 on the protection of trademarks.
Why does the accuracy of published information matter?
Because the proceeds from asset realization are destined exclusively for the creditors. Materials that present the situation in an incomplete or outdated manner deter buyers of the remaining assets and prevent their realization at fair value. The direct consequence is borne not by the company but by the body of creditors, and the execution of the court-confirmed Plan becomes more difficult.

Upon request, the administrators provide copies of the court decisions listed on this page and of the trademark registration certificate. The right of reply and rectification is governed by Law No. 64/2010 on freedom of expression.
